Waivers Don't Eliminate Risk โ€” But They Manage It

Adventure activities (hiking, rafting, cycling, zip-lining) carry inherent risks. Liability waivers inform participants of these risks and demonstrate that they accepted them voluntarily. While waivers don't provide absolute legal protection, they significantly strengthen your position.

Essential Waiver Components

  1. Description of activities โ€” specific activities included in the tour
  2. Risk acknowledgment โ€” "I understand that [activities] involve risks including but not limited to..."
  3. Assumption of risk โ€” "I voluntarily assume all risks and responsibilities"
  4. Release of liability โ€” "I release [Company Name] from liability for any injury, loss, or damage"
  5. Medical fitness declaration โ€” "I am physically fit to participate" or disclose conditions
  6. Emergency medical authorization โ€” permission to provide emergency treatment
  7. Signature and date โ€” must be signed before the activity begins

Making Waivers Effective

  • Clear language โ€” avoid legal jargon. The signer must understand what they're agreeing to.
  • Specific risks listed โ€” "risk of falling, drowning, equipment failure" is stronger than "general risks"
  • Voluntary signing โ€” no pressure. If someone refuses, offer a refund for the activity portion.
  • Separate from booking terms โ€” waivers should be distinct documents, not buried in T&Cs.
  • Digital signatures accepted โ€” most jurisdictions accept electronic signatures
